class. At the end of the day she noticed a boy, one of her classmates,
mounting his bicycle and riding home without his helmet. The supervising
teacher also observed the boy leaving without his helmet, but did nothing to
reprimand or stop him. However, when Marissa tried to leave, the teacher
confiscated her bicycle and yelled at her. Marissa was arrested for assault
because she shook her finger in the teacher’s face and the teacher "felt
threatened."

Jessica was arrested for biting her sister’s arm in a fight. While in custody, the troubled girl kicked a jail guard, and she was convicted of second-degree assault of a correctional officer. This story is not totally devoid of compassion. The judge tried hard to send her to an intensive program for emotionally troubled teenagers. A deal was cut with the DA but while in the hospital, waiting for a bed, Jessica set fire to a mattress. The deal collapsed. The judge made one of his most painful decisions in his 32-year career and sent Jessica to prison for 3 1/2 to 7 years. Jessica was up against the enormous and overburdened New York state penal system. Really, from the day she entered the system, she didn’t have a chance. Because of overcrowding with murderers, thieves, gang members, drug addicts, and the mentally ill, the idea of rehabilitation is virtually nonexistent. Disciplinary systems such as the box were a part of the system’s futile efforts to control the population for escalating infractions. A group of attorneys, psychiatrists, and legislators visited New York’s special units and found that while some inmates being held in the box were the worst of the worst in terms of violent infractions, most were in the box for lesser violations, and many were mentally disturbed. Jessica herself had been cited for refusing to tuck in her shirt, tossing toilet water, smoking cigarettes in her cell, and shouting obscenities at staff members.
