Accused Halloween sex fiend Peter Braunstein may be unable to appear at a trial scheduled for next week because his skull was fractured in jail and he suffers from "severe headaches," his lawyer said yesterday.
But an infuriated Assistant District Attorney Maxine Rosenthal accused Braunstein of injuring himself in a bid to stall the trial.
Braunstein, 42, is charged with imprisoning and sexually assaulting a 34-year-old former Women's Wear Daily colleague in her Manhattan apartment on Halloween night in 2005.
He was on the run for six weeks before being captured by authorities.
Manhattan Supreme Court Justice James Yates has scheduled a hearing on Braunstein's medical condition for today. Dr. Grace Lee, a Bellevue Hospital psychiatrist who has been treating Braunstein, will testify.
The judge revealed yesterday that Braunstein has three skull fractures and five blood clots on the brain.
Braunstein's lawyer, Robert Gottlieb, denied that the injuries were self-inflicted and said it was unclear whether his client could sit through a full day of trial "without interruptions because of severe headaches."
