Who's fault is it

Last night I was out at a bar and this guy is at the bar wasted beyond belief. So he orders another beer and and the bartender serves it to him. So being as wasted as he is he starts having words with this girl at the bar and her guy friend gets involved. Well one thing leads to another and the manager tries to calm the drunk guy down. The drunk guy punches the manager in the face and all of a sudden there is 5 guys on this guy. So they drag him out the back door. The drunk guy calls the police and starts banging on the front door. Who's fault is it? :hmmm

The Bartender for over serving him?

The drunk guy for starting the fight?

Obviously, drunk or not you aren't supposed to start fights but technically the bartender is liable for overserving him.

I know a girl who was arrested for overserving and something like this happened.

the drunk's fault. They have the right to remove him forcefully, but if he sustained any serious injury and has a good lawyer, he could get paid. Sad, but true. :booted violent drunks :disgusted

should be the clubs fault...but many similar cases have happend and never been to trial...Its very hard to prove negligence from the club...so far no judge has allowed such incidents to go to trial...

If its in NJ the bar is at fault if the guy is being served if the guy visibly drunk

no one is at fault, until is it reviewd by a Judge and as I said EMM DOOG, no such case has succeded...if this one does...then almost every case will in the future and politics will prevent that from happening...

one thing I forgot to input....the club could possibly get fined by the police for the incident...but they will apeal and win it with out any problems...ok i m done EMMMYYYY ur wrong I m right...get back to me when u find out if u can hook it up for the 19th...luv u more than JP loves mia... bye ha!
